We may be only a few months in, but 2020 has already seen pretty significant changes in terms of labor and employment law realities, regulations and enforcement:
- COVID-19: Employers in every sector and industry have spent the better part of 2020 addressing operational, financial and regulatory issues related to COVID-19. This includes significant reform to paid leave for many employers and efforts from the federal, state and local governments to assist employers navigating this unusual time.
- FMLA and ADA Developments: Despite the focus on COVID-19, the courts, the DOL and the EEOC continue to keep FMLA and ADA issues as a key priority, as employee claims are not slowing down.
- Wage and Hour Trends and the New “Overtime” Rule: Wage and hour litigation and enforcement from the DOL continues to be a hot topic as the DOL’s long-awaited new overtime rule went into effect which raised the the minimum standard salary/exempt threshold for overtime pay under the Fair Labor Standards Act (FLSA) from $23,660/year to $35,568/year.
- Unique Drug and Alcohol Issues for Employers: The increase in recreational and/or medicinal use of marijuana, the opioid crisis and employee use of prescription medications have required employers to revisit testing, abuse and discipline issues.
